The Florida Second-Home Protection Checklist

Florida homestead protects one house. Your second home — whether it is a vacation home, rental, seasonal residence, future retirement home, or snowbird property — may sit outside that protection entirely.

Why this matters

Your second home may be exposed in ways your primary residence is not.

Florida gives powerful protection to the home you live in — but that protection generally attaches to one primary residence. A second home can create liability, creditor, probate, tax, and ownership questions that many families do not discover until there is a claim, tenant issue, refinancing problem, or estate dispute.

What the checklist helps you review

Find the gaps before a tenant, guest, creditor, or probate issue does.

Ownership & Titling See whether the property is held personally, jointly, in an LLC, in a trust, or in a structure that may need review.
Rental & Guest Liability Review whether the way the property is used — personal, seasonal, short-term rental, or long-term rental — creates additional exposure.
Estate Planning & Probate Identify whether the second home is coordinated with your revocable living trust, inheritance plan, and long-term family goals.
Privacy & Asset Protection Learn why land trusts, multi-member LLCs, insurance, and proper entity separation may matter depending on how the property is used.

This checklist is especially valuable if you:

  • Own or plan to buy a Florida second home
  • Use the property as a vacation home or seasonal residence
  • Rent the property annually, seasonally, or short-term
  • Hold the property in your personal name or joint name
  • Set up a single-member LLC and assumed that was enough
  • Split time between two homes and need a deliberate homestead plan
  • Want the property integrated into your estate plan

Your Second-Home Exposure Rating

The checklist walks you through 15 questions and helps you score whether your second-home structure appears well-armored, has meaningful gaps, or may have substantial exposure worth reviewing immediately.

Green: 0–3 Risk Points Your second-home structure may be aligned with its use and ownership plan.
Yellow: 4–8 Risk Points There may be gaps involving title, rental use, privacy, estate planning, or entity structure.
Red: 9–15 Risk Points The property may be substantially exposed, especially if it is personally titled or used as a rental.
Common misconception

Homestead protection does not automatically cover the other house.

Many owners assume their Florida homestead protection, homestead tax exemption, or Save Our Homes cap somehow extends to a second property. The checklist helps clarify why the second home needs its own protection strategy.
