What Is Estate Planning?

Estate planning organizes your assets, business interests, and end-of-life wishes into a legally binding plan. Done well, it does more than distribute property — it names who can act for you if you cannot, keeps your family out of court, and coordinates with the trusts and entities you already have.

A revocable living trust is a legal arrangement you create during your lifetime to hold and manage assets. You generally remain in control as trustee and can change or revoke the trust while living. When properly funded, it can provide continuity during incapacity and allow trust-owned assets to pass to beneficiaries without probate. Common structures also include wills, land trusts, irrevocable trusts, powers of attorney, LLCs, and advance healthcare directives.

Estate Planning Questions We Hear Most

Do I still need a will if I have a trust?
Yes. Even a well-funded trust should be paired with a "pour-over" will to catch any assets that were not retitled into the trust before death, and a will is also where you name a guardian for minor children.
What happens to my Florida homestead if I don't have a plan?
If you die without directing where your homestead goes and you are survived by a spouse and descendants, Florida law generally gives your spouse a life estate in the home with your children receiving the remainder interest — or your spouse can elect an undivided one-half interest instead. Without proper planning, your family does not get to choose; the law decides for them.
Can my spouse be left out of my estate plan entirely?
Generally, no. Florida law protects a surviving spouse's right to claim a share of the estate, regardless of what a will provides, unless that right has been waived in a valid prenuptial or postnuptial agreement.
Can you create my estate plan if I do not already have trusts or LLCs?
Yes. You do not need an existing structure before working with us.
